    Drunk driving arrests can have very real consequences financially, socially, professionally, and severely restrict or even remove your driving privileges entirely.  That’s why it is incredibly important to remember what your rights are, how to confidently assert them, and what to do if the unthinkable happens to you.

    Here are some tips to remember if you ever find yourself in this awful situation.

    As it Pertains to the Breath Test – DOs and DON’Ts

    • If you are a first-time offender and your arrest does NOT involve an accident causing serious injury or death, then you should agree to take the test.
    • If you have been involved in and arrested for an accident causing serious injury or death, then you MAY CHOOSE not to take the test.
    • If the officer/s request that you take a breath, urine, or a blood test, and you refuse to do so…you will likely lose your driver’s license for one year [ if this is your second refusal in the last seven years then it’s going to be TWO YEARS!].
    • The police can seek a warrant if you refuse the breath test.
    • If you do decide to take the test, take several deep breaths beforehand so that you get as accurate a reading as possible and mouth alcohol not taint it.
    • And if you think the result of the breath test is way too high and you’re certain of this, demand the police take you to the nearest hospital to do what’s called a “whole” blood test. You have this right to make this demand.

    Additionally, it is incredibly important that you understand that upon arrest you do not have to, nor should you ever, make any statements to police without an attorney present.  This includes any statements about how much you had to drink, or where you may have been drinking beforehand!  All the information the officers need from you can be found on your license and on your vehicle registration!
